{"id":764,"date":"2015-10-23T06:00:31","date_gmt":"2015-10-23T06:00:31","guid":{"rendered":"http:\/\/www.ftcguardian.com\/articles\/?p=764"},"modified":"2017-03-17T06:24:26","modified_gmt":"2017-03-17T06:24:26","slug":"ftc-ruling-bans-biodegradable-on-products","status":"publish","type":"post","link":"https:\/\/www.ftcguardian.com\/articles\/ftc-ruling-bans-biodegradable-on-products\/","title":{"rendered":"FTC Ruling \u2018Bans Biodegradable\u2019 on Products"},"content":{"rendered":"<h2>FTC Ruling \u2018Bans Biodegradable\u2019 on Products, ECM Biofilms Says<\/h2>\n<p>The Federal Trade Commission has ruled that ECM BioFilms acted deceptively by making false and unsubstantiated environmental claims by saying its product is <a href=\"http:\/\/www.environmentalleader.com\/tag\/biodegradable\/\">biodegradable<\/a>.<\/p>\n<h4>ECM BioFilms claimed its product, a chemical additive, would make treated <a href=\"http:\/\/www.environmentalleader.com\/category\/plastics\/\">plastics<\/a> biodegrade in a landfill within nine months to five years.<\/h4>\n<p><a href=\"http:\/\/go.ftcguardian.com\/bw4uoy\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/s3.amazonaws.com\/ftcguardian\/images\/728x90-Un-vjy-FTC-GUARDIAN-banner-2.gif\"\/><\/a><\/p>\n<h4>The <a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/cases\/151019ecmorder.pdf\">FTC\u2019s final order<\/a> bars ECM from representing that a plastic product or package is degradable, or that any product or service affects a plastic product\u2019s degradability, unless the representation is true, not misleading, and substantiated by competent and reliable scientific evidence. It also requires that for claims relating to degradability of plastic products, ECM must ensure that either: 1) the entire plastic item will completely decompose into elements found in nature within five years after customary disposal; or 2) the claim is clearly and prominently qualified by either the time for complete decomposition or the type of non-customary disposal required and the availability of such disposal facilities.<\/h4>\n<h4>The FTC\u2019s decision reverses its administrative law judge\u2019s earlier decision. It follows the <a href=\"http:\/\/www.environmentalleader.com\/2014\/11\/07\/ftc-biodegradable-claim-smackdown-continues\/\">FTC\u2019s recent crackdown<\/a> on companies\u2019 claims that their products are biodegradable.<\/h4>\n<h4>ECM Biofilms\u2019 attorney says the FTC\u2019s final order effectively bans the term \u201cbiodegradable.\u201d<\/h4>\n<h4>\u201cThis is an egregious instance of abuse of agency discretion,\u201d said Jonathan Emord of Emord & Associates, the firm representing ECM Biofilms. \u201cThe ALJ correctly ruled on the record evidence that the ECM product renders plastic intrinsically biodegradable and accelerates plastic biodegradation \u2014 in other words that it works.
