{"id":5241,"date":"2017-07-23T16:07:09","date_gmt":"2017-07-23T16:07:09","guid":{"rendered":"https:\/\/www.ftcguardian.com\/articles\/?p=5241"},"modified":"2017-07-23T16:07:09","modified_gmt":"2017-07-23T16:07:09","slug":"your-ignorance-of-privacy-protected-information-causes-massive-ftc-fines","status":"publish","type":"post","link":"https:\/\/www.ftcguardian.com\/articles\/your-ignorance-of-privacy-protected-information-causes-massive-ftc-fines\/","title":{"rendered":"Your Ignorance Of  Privacy-Protected Information  Causes Massive FTC Fines  \u00a0"},"content":{"rendered":"<h1><strong>Your Ignorance Of\u00a0<\/strong><strong>Privacy-Protected Information\u00a0<\/strong><strong>Causes Massive FTC Fines<\/strong><\/h1>\n<h3><strong>You Don't Know What Information Is\u00a0<\/strong><strong>Privacy-Protected & What To Do About It!\u00a0<\/strong><strong>(Hint \u2013 Social Media And Mobile Apps\u00a0<\/strong><strong>Are Huge Traps For the Unwary!!)<\/strong><\/h3>\n<p>By Chip Cooper, Esq<\/p>\n<p><strong>Background<\/strong><\/p>\n<p>You\u2019re an online entrepreneur, or maybe you even view yourself as an \u201cIM\u201d, and Internet marketer &#8211; a special breed of cat that\u2019s a subset of online entrepreneurs.<\/p>\n<p>In either case, it doesn\u2019t matter if you\u2019re a veteran or a beginner.\u00a0 It doesn\u2019t even matter if you work in a home office, or in a real, brick and mortar office.\u00a0 You know one important, overriding thing.<\/p>\n<p>And that\u2019s the value of your email marketing list.\u00a0 The holy grail of online marketing.<\/p>\n<p>With a responsive email list, you can grow your business.\u00a0 You can market additional products, services, or information you might create in the future.<\/p>\n<p>Or, you may market complimentary stuff of others \u2013 your JV partners.<\/p>\n<p>You\u2019ve known from day 1 that the single greatest asset of your growing online business is your email marketing list.\u00a0 That\u2019s why you expend so much time and effort growing it.<\/p>\n<p>What you probably don\u2019t know is this \u2013 it\u2019s what\u00a0 I call the \u201cgreat paradox\u201d.\u00a0 The fact that your most valuable asset is also your single greatest source of legal liability.\u00a0 Massive liability that could shut your business down in a single day.<\/p>\n<p><a class=\"popup_BIG_DATA\" data-toggle=\"modal\" data-target=\"#popup_BIG_DATA_modal\" href=\"#\"><img decoding=\"async\" src=\"\/images\/button_banner-Big_Data_Report.png\" alt=\"\" \/><\/a><\/p>\n<p>This critical fact has been known by Internet attorneys like me for some time.\u00a0 But among online entrepreneurs and IM\u2019s, not very much at all.<\/p>\n<p>And this is a huge problem if you continue to focus solely on building your list &#8211; at the expense of caring for it and protecting yourself as you grow and use it.<\/p>\n<p><strong>Tip<\/strong> \u2013 You absolutely, positively need to pay more attention to protecting your email list and yourself.\u00a0 And that begins with understanding what information is privacy-protected!<\/p>\n<p><strong>How Privacy Regulation Began in the United States<\/strong><\/p>\n<p>Certain information is privacy-protected.\u00a0 It\u2019s protected so much by the FTC that it\u2019s almost viewed as sacred.\u00a0 And this is the basis for all legal regulations that affect your list. The best way to get a perspective on privacy-protected information is to understand how privacy regulation began in the United States.<\/p>\n<p>It all started back in 2004 in California, not in the U.S. Congress.\u00a0 The California Online Privacy Protection Act (OPPA) became effective on July 1, 2004. OPPA requires website operators who collect online \u201cpersonally identifiable information\u201d from California residents to post a Privacy Policy on their websites.<\/p>\n<p>So, at the time of the beginning of formal privacy protection in the U.S. privacy-protected information was limited to \u201cpersonally identifiable information\u201d which included:<\/p>\n<ul>\n<li>first name, last name,<\/li>\n<li>street address,<\/li>\n<li>email address,<\/li>\n<li>phone number, and<\/li>\n<li>social security number<\/li>\n<\/ul>\n<p>In addition, privacy-protected information included other information if linked to any of the above elements of \u201cpersonally identifiable information\u201d such as:<\/p>\n<ul>\n<li>height<\/li>\n<li>weight<\/li>\n<li>occupation<\/li>\n<li>birth date<\/li>\n<\/ul>\n<p>After OPPA went into effect, websites selling the products into the United States began to post Privacy Policies that were OPPA-compliant.\u00a0 This was the result for two basic reasons:<\/p>\n<ul>\n<li>it would have been difficult to screen out California residents with confidence, and<\/li>\n<li>who among Internet marketers and online entrepreneurs would want to screen out California residents anyway, since California is such a large market.<\/li>\n<\/ul>\n<p>So, in essence, OPPA became a de facto federal statute of general application, meaning that it applied the general market, and was not restricted in application to specific markets.<\/p>\n<p>There are federal statutes that protect\u00a0 privacy of specific information (as distinguished from statutes of general application such as OPPA.\u00a0 A few of these are :<\/p>\n<ul>\n<li>Health Insurance Portability and Accountability Act of 1996 (HIPAA) for patient health records,<\/li>\n<li>Gramm-Leach-Bliley Act (GLBA) for financial information,<\/li>\n<li>Children\u2019s Online Privacy Protection Act (COPPA) for personal information of children under age 13, and,<\/li>\n<li>Fair Credit Reporting Act (FCRA) for data collected by consumer reporting agencies.<\/li>\n<\/ul>\n<p><strong>Note<\/strong> \u2013 To this day, however, California\u2019s OPPA statute is the only privacy statute of general application in the U.S.\u00a0 The FTC regulates privacy under the general principles of Section 5 of the FTC Act.\u00a0 For more information regarding the FTC\u2019s authority, see the Chapter titled \u201cWhat Does This Mean to You\u201d.<\/p>\n<p><strong>Social Media-Related Additions To Privacy-Protected Information<\/strong><\/p>\n<p>One big headache for Internet marketers and online entrepreneurs is that privacy-protected information is a moving target, meaning that it changes from time to time, as new technology leads to new privacy concerns.<\/p>\n<p><strong>Warning!<\/strong> \u2013 Because privacy-protection information is in a constant state of evolution, marketers must remain vigilant for new additions, or risk huge fines for non-compliance with ever-expanding privacy regulations.<\/p>\n<p>For example, perceived abuses regarding social media caused the FTC to expand the scope of privacy-protected information.<\/p>\n<p>On March 20, 2011, the FTC announced its proposed settlement regarding Google's social media online service known as \u201cBUZZ\u201d.<\/p>\n<p>In the proposed settlement, the FTC added new categories of privacy-protected information, which include:<\/p>\n<ul>\n<li>Physical location data,<\/li>\n<li>screen names, and<\/li>\n<li>lists of contacts.<\/li>\n<\/ul>\n<p><strong>Tip<\/strong> \u2013 Beginning with the Google settlement on March 20, 2011, marketers must treat physical location data, screen names, and lists of contacts as privacy-protected information.<\/p>\n<p><a href=\"http:\/\/go.ftcguardian.com\/bw4uoy\"><img decoding=\"async\" src=\"https:\/\/s3.amazonaws.com\/ftcguardian\/images\/728x90-Un-vjy-FTC-GUARDIAN-banner-2.gif\" \/><\/a><\/p>\n<p><strong>Mobile App-Related Privacy Rules<\/strong><\/p>\n<p>Both the State of California and the FTC have moved to regulate the booming market for mobile phone applications known as \u201capps\u201d.<\/p>\n<p>Privacy concerns were heightened as a result of several incidents involving mobile phones, including:<\/p>\n<ul>\n<li>a blogger discovered that a social network app had uploaded his mobile phone contacts without permission,<\/li>\n<li>a photo sharing app also was found to upload user\u2019s contact without permission, and<\/li>\n<li>Twitter acknowledged uploading users\u2019 contacts from mobile phones without permission.<\/li>\n<\/ul>\n<p>On February 22, 2012, the California Attorney General announced that the California Online Privacy Protection Act (OPPA) applies not only to protected information collected through websites, but also via apps on mobile devices.<\/p>\n<p>The result: mobile apps that collect privacy-protected information, including physical location data, from California residents should have a Privacy Policy just as websites do.<\/p>\n<p>Shortly thereafter in August, 2012, the FTC jumped on the mobile app privacy bandwagon by announcing in its report titled \u201cMarketing Your Mobile App \u2013 Get it Right From The Start\u201d that, among other requirements, mobile app publishers should:<\/p>\n<ul>\n<li>get express, affirmative consent before collecting sensitive data such as \u201cgeo-location\u201d, medical, or financial data, and<\/li>\n<li>obtain verified parental consent before collecting personal information from children under 13 (U-13\u2019s).<\/li>\n<\/ul>\n<p><strong>Tip<\/strong> \u2013 Social media and mobile apps are just the latest developments that trigger new privacy regulations.\u00a0 New regulations will be coming down the pike at an increasing rate.\u00a0 Keep up and comply with them, or suffer huge headaches and massive fines!<\/p>\n<p><strong>What to Do About Your Collection And Use of Protected Information<\/strong><\/p>\n<p>Once you know what information is privacy-protected, it\u2019s critical that you know what to do about it in terms of disclosures in your Privacy Policy.<\/p>\n<p>In general terms, your Privacy Policy, regardless of whether it is posted on your website or via your mobile app, should disclose the following:<\/p>\n<ul>\n<li>the dates that the Privacy Policy takes effect,<\/li>\n<li>the categories of privacy-protection information collected,<\/li>\n<li>how privacy-protected information is collected,<\/li>\n<li>how users may change privacy-protected information,<\/li>\n<li>the process for notification regarding changes to the Privacy Policy, and<\/li>\n<li>how privacy-protected information is shared or made accessible to others, particularly for marketing purposes.<\/li>\n<\/ul>\n<h2>Here\u2019s How To Make
