{"id":3442,"date":"2017-02-25T02:43:38","date_gmt":"2017-02-25T02:43:38","guid":{"rendered":"https:\/\/www.ftcguardian.com\/articles\/?p=3442"},"modified":"2018-03-18T23:11:32","modified_gmt":"2018-03-18T23:11:32","slug":"the-high-cost-of-fake-testimonials-endorsements","status":"publish","type":"post","link":"https:\/\/www.ftcguardian.com\/articles\/the-high-cost-of-fake-testimonials-endorsements\/","title":{"rendered":"The High Cost of Fake Testimonials \/ Endorsements"},"content":{"rendered":"<h1>The High Cost of Fake Testimonials \/ Endorsements<\/h1>\n<p>By Chip Cooper, Esq.<\/p>\n<p><b>If You\u2019re Tempted To Use Fake Endorsements \u2013 Don\u2019t Do It!<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Federal Trade Commission\u2019s recent settlement with Reverb Communications is the FTC\u2019s first case targeting deceptive advertising on the Internet since the FTC <\/span><span style=\"font-weight: 400;\">Guidelines <\/span><span style=\"font-weight: 400;\">were announced late in 2009. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you use online endorsements or testimonials from others, you should review your internal marketing policies and your FTC website forms to avoid substantial liability for deceptive advertising.<\/span><\/p>\n<p><b>The Reverb Communications Case<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Reverb Communications is a public relations firm representing major clients in the video game industry, including clients such as MTV Games and Harmonix, as well as smaller firms that sell mobile game apps via the iTunes store. According to the FTC, Reverb\u2019s fee often includes a percentage of the sale of its clients\u2019 gaming apps.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The iTunes store provides users the ability to post reviews of gaming applications that are available for purchase. These reviews include a rating system (based on a possible rating of one to<\/span><span style=\"font-weight: 400;\"> five <\/span><span style=\"font-weight: 400;\">stars) and written text.<\/span><\/p>\n<p><a class=\"popup_SDLM\" data-toggle=\"modal\" data-target=\"#popup_SDLM_modal\" href=\"#\"><img decoding=\"async\" src=\"\/images\/button_banner-SDLM.png\" alt=\"\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400;\">According to the FTC, during a period of approximately one year Reverb employees posted reviews in the iTunes store favorable to games of Reverb\u2019s clients. The reviews were posted in a manner that would convey the impression tha<\/span><span style=\"font-weight: 400;\">t unaffiliated or non associated consumer<\/span><span style=\"font-weight: 400;\">s had posted them.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition to giving five-star ratings to Reverb\u2019s clients\u2019 games, Reverb\u2019s employees posted written endorsements such as:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\"> \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span style=\"font-weight: 400;\">\u201cAmazing new game\u201d,<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span style=\"font-weight: 400;\">\u201cONE of the BEST\u201d, and<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span style=\"font-weight: 400;\">\u201cReally cool game\u201d.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The FTC brought suit claiming that Reverb engaged in deceptive advertising by having its employees pose as ordinary consumers posting reviews, while \u00a0failing to disclose that the reviews were from paid employees working on behalf of their clients. Reverb agreed to settle the case.<\/span><\/p>\n<p><a href=\"http:\/\/go.ftcguardian.com\/bw4uoy\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" src=\"https:\/\/s3.amazonaws.com\/ftcguardian\/images\/728x90-Un-vjy-FTC-GUARDIAN-banner-2.gif\" \/><\/a><\/p>\n<p><b>Lessons Learned<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The basic lesson is clear \u2013 don\u2019t use employees or contractors to post fake endorsements under <\/span><b><i>any circumstances<\/i><\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The FTC stated in its press release announcing the Reverb settlement: \u201cCompanies, including public relations firms involved in online marketing need to abide by long-held principles of truth in advertising. \u00a0Advertisers should not pass themselves off as ordinary consumers touting a product\u2026\u201d.<\/span><\/p>\n<p><b>What to Do?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">What if you post actual endorsements (not fake ones) from satisfied customers on your website \u2013 or if you allow bloggers to post endorsements on your site? <\/span><\/p>\n<p><span style=\"font-weight: 400;\">What is required to avoid a deceptive advertising claim by the FTC? \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If some of your endorsers receive a fee or some kind of benefit in connection with their endorsements, you need to place a link in close proximity to the endorsement that links to disclosure text such as:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Some or all of the endorsers who provide testimonials or comments on this site regarding this site, its products or services may receive payment in the form of affiliate commissions, referral fees, or promotional materials or benefits from us.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Although you might assume that these endorsements are biased by reason of compensation, to the best of our knowledge we believe these endorsements represent the honest opinions of the endorsers.<\/span><\/li>\n<\/ul>\n<p><b>Conclusion<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The FTC settlement with Reverb requires Reverb to remove the previously posted deceptive endorsements and to refrain from using employees to post fake reviews for its clients in the future. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Reverb case indicates that the FTC is very serious about enforcement of its Guides that were announced late last year and you can e<\/span><span style=\"font-weight: 400;\">xpect more FTC enforcement actions in the near future.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2>Here\u2019s How To Make Sure You,\u00a0Your Business & Website Is FTC Compliant<\/h2>\n<p>By now it should be clear how important it is for you to be FTC compliant.
