<p>The fear of being hacked was allegedly the hook used by Office Depot, its subsidiary OfficeMax, and a California tech-support vendor to dupe customers into paying for computer repairs and technical services they didn’t need, according to the Federal Trade Commission.</p>
<p><a class="popup_SDLM" data-toggle="modal" data-target="#popup_SDLM_modal" href="#"><img decoding="async" src="/images/button_banner-SDLM.png" alt="" /></a></p>
<p>Although not admitting any wrongdoing, Office Depot and Support.com Inc. have agreed to pay $35 million to settle the claim they deceived customers into believing their computers were infected with malware and vulnerable to other security threats.</p>
<p>The FTC alleged that from at least 2009 to late 2016, the companies would offer customers a free “PC Health Check Program” to determine if their computers had any performance problems.</p>
<p>But the real purpose was to aggressively sell diagnostic and repair services to customers that, in many cases, they didn’t need, according to Claire Wack, the FTC’s lead attorney on the case.</p>

<p>Following a complaint by the F.T.C., a federal judge has ordered a large publisher of online scientific journals to change its business practices &#8212; and to pay an enormous judgment.</p>
<p>In the world of scientific research, they are pernicious impostors. So-called predatory journals, online publications with official-sounding names, publish virtually anything, even gibberish, that an academic researcher submits — for a fee.</p>
<p><a class="popup_7TLM_Cheat_Sheet" data-toggle="modal" data-target="#popup_7TLM_Cheat_Sheet_modal" href="#"><img decoding="async" class="aligncenter" src="/images/button_banner-7TLM_Cheat_Sheet.png" alt="" /></a>Critics have long maintained that these journals are eroding scientific credibility and wasting grant money. But academics must publish research to further their careers, and the number of questionable outlets has exploded.</p>
<p>Now the Federal Trade Commission has stepped in, announcing on Wednesday that it has won a $50 million court judgment against Omics International of Hyderabad, India, and its owner, Srinubabu Gedela.</p>
<p>Omics publishes hundreds of journals in such areas as medicine, chemistry, and engineering. It also organizes conferences. The F.T.C. claimed that Omics violated the agency’s prohibition on deceptive business practices.</p>

<p>Food delivery services can be a convenience for people with busy lives. Free trial offers and online reviews can help people decide which service they want to use.</p>

<p>But when reviews are deliberately skewed and subscription terms are hidden, that’s not just unhelpful. It’s against the law.</p>
<p>The FTC announced a settlement with UrthBox, Inc., a California-based food delivery service, and its owner, Behnam Behrouzi.</p>
<p>According to the FTC, UrthBox offered customers incentives, including free snack boxes, to post positive reviews online. But the company didn’t clearly tell people that customers who posted those reviews were rewarded.</p>

<p>If you’re driving a late model car or truck, chances are that the vehicle is mostly computers on wheels, collecting and wirelessly transmitting vast quantities of data to the car manufacturer not just on vehicle performance but personal information, too, such as your weight, the restaurants you visit, your music tastes and places you go.</p>
<p>A car can generate about 25 gigabytes of data every hour and as much as 4,000 gigabytes a day, according to some estimates. The data trove in the hands of car makers could be worth as much as $750 billion by 2030, the consulting firm McKinsey has estimated. But consumer groups, aftermarket repair shops and privacy advocates say the data belongs to the car’s owners and the information should be subject to data privacy laws.</p>
<p><a class="popup_DATA_BROKER" data-toggle="modal" data-target="#popup_DATA_BROKER_modal" href="#"><img decoding="async" src="/images/button_banner-Data_Broker.png" alt="" /></a></p>
<p>Yet Congress has yet to pass comprehensive federal data privacy legislation. And although Sen. Roger Wicker of Mississippi, chairman of the Senate Committee on Commerce, Science, and Transportation, has said he would like to see federal privacy legislation passed by the end of the year, it is unclear if that goal can be met.</p>
<p>Consumers are right to be concerned that, unknown to them, data collected by car companies could be shared with law enforcement agencies, just as online ancestry registries have shared DNA information with investigators, said Sally Greenberg, executive director of the National Consumers League. Drivers who connect their smartphones and other devices via Bluetooth to their cars could be sharing their entertainment and eating habits as well as their entire contacts list with the car’s manufacturer, or with a rental car company, Greenberg said.</p>

<p>Disabled Police and Sheriffs Foundation, and its founder, Kenik, collected almost $10 million in donations from 2013 through 2017 allegedly to provide assistance to disabled officers and relief to families of officers killed in the line of duty. Instead, Kenik spent the vast majority of contributions to profit himself and private individuals he hired instead of on charitable programs.</p>
<p>The settlement will be for $9,932,323, with all of that suspended except for $100,000, due to defendants’ inability to pay. The $100,000 will be distributed to a legitimate charity whose charitable purpose is substantially similar to the purpose for which defendants solicited funds, as recommended by Schmitt’s office and approved by the court. Kenik will also be banned from soliciting charitable contributions and must cooperate with any further investigations into his actions.</p>

<p>Two U.S. senators introduced a bipartisan bill that would ban “manipulative” design features and prompts that let large websites such as Alphabet’s Google or Facebook “trick consumers into handing over their personal data.”</p>
<p>Democratic Senator Mark Warner and Republican Senator Deb Fischer introduced the bill on so-called “dark patterns” on Tuesday, according to a news release from Warner’s office. Such features, based on behavioral psychology, include pre-checked boxes or pop-ups in the middle of an activity—such as an e-commerce purchase or reading a story online—that prompt users to consent to the collection of personal data.</p>
<p><a class="popup_BIG_DATA" data-toggle="modal" data-target="#popup_BIG_DATA_modal" href="#"><img decoding="async" src="/images/button_banner-Big_Data_Report.png" alt="" /></a></p>
<p>The bill, which would only apply to websites with more than 100 million monthly active users, comes as anger with large internet platforms has led to rising calls for regulation. Although the bill introduced Tuesday is bipartisan, key committees that would have to legislate on the issue have not yet picked up the effort. So far, congressional efforts to pass a national privacy law have gained the most momentum with lawmakers.</p>
<p>“For years, social media platforms have been relying on all sorts of tricks and tools to convince users to hand over their personal data without really understanding what they are consenting to,” Warner, who serves as vice chairman of the Senate Intelligence Committee, said in a statement. The legislation is dubbed DETOUR, for “Deceptive Experiences to Online Users Reduction” Act.</p>

<p class="">The agencies claim that three companies — Nutra Pure, PotNetwork Holdings, and Advanced Spine and Pain — are falsely advertising the effectiveness of supplements that contain cannabidiol, commonly known as CBD. The products are marketed under names such as “Hemp Oil,” “CBD Softgels,” “CBD for Dogs,” “Liquid Gold Gummies,” and “CBD Oil.” One company in particular — Nutra Pure — advertises that scientific research supports their claims that their CBD product is an effective anti-seizure medication.</p>

<p>A lawsuit filed against Nestlé Waters, which owns Poland Spring, claimed that the company was deceiving customers by selling them “ordinary groundwater” that Poland Spring “collects from wells it drilled,” and marketing it as “100% natural spring water.”</p>

<p>The suit called Poland Spring’s water “a colossal fraud perpetrated against American consumers.”</p>
<p>Nestlé tried to get the case dismissed, a US district attorney in Connecticut ruled that plaintiffs from eight states, including Massachusetts, New York, and Pennsylvania, can pursue their lawsuit against the company.</p>
<p>This is not the first time Nestlé has been accused of false advertising. In 2003, according to the Washington Post, it paid $10 million to charity after it was hit with a similar class-action lawsuit regarding Poland Spring and false advertising.</p>

<p>The U.S. Federal Trade Commission, which investigates allegations of deceptive advertising, has sent warning letters to eight companies to insist they distinguish in advertisements between diamonds from mines and those made in laboratories.</p>

<p>The FTC said it had found instances where the eight companies advertised diamond jewelry “without clearly and conspicuously disclosing that the diamonds are laboratory-created,” according to the letter.</p>
<p>The agency declined to identify the recipients of the letters. An unredacted version of one of the letters seen by Reuters identified that recipient as Diamond Foundry, a California company that makes laboratory diamonds.</p>

<p>Epic Games Inc., the maker of the popular video game “Fortnite,” conned players into buying so-called loot boxes that rarely contained the valuable in-game accouterments promised by the company's advertising, according to a proposed class action filed in California federal court.</p>
<p><a class="popup_BIG_DATA" data-toggle="modal" data-target="#popup_BIG_DATA_modal" href="#"><img decoding="async" src="/images/button_banner-Big_Data_Report.png" alt="" /></a></p>
<p>The suit filed claims Fortnite's “Save the World” game mode allows players to purchase loot boxes known as “Llamas,” which were marketed “as highly likely to contain valuable loot that will increase a player's power and prowess” but actually contained mostly basic items.</p>
<p>The complaint cites research indicating children may be less able to think critically about how in-game purchases are advertised, and alleges Epic exploits that naivete to reap huge profits.</p>
