Your car is watching you. Who owns the data?

By Gopal Ratnam

If you’re driving a late model car or truck, chances are that the vehicle is mostly computers on wheels, collecting and wirelessly transmitting vast quantities of data to the car manufacturer not just on vehicle performance but personal information, too, such as your weight, the restaurants you visit, your music tastes and places you go.

A car can generate about 25 gigabytes of data every hour and as much as 4,000 gigabytes a day, according to some estimates. The data trove in the hands of car makers could be worth as much as $750 billion by 2030, the consulting firm McKinsey has estimated. But consumer groups, aftermarket repair shops and privacy advocates say the data belongs to the car’s owners and the information should be subject to data privacy laws.

Yet Congress has yet to pass comprehensive federal data privacy legislation. And although Sen. Roger Wicker of Mississippi, chairman of the Senate Committee on Commerce, Science, and Transportation, has said he would like to see federal privacy legislation passed by the end of the year, it is unclear if that goal can be met.

Consumers are right to be concerned that, unknown to them, data collected by car companies could be shared with law enforcement agencies, just as online ancestry registries have shared DNA information with investigators, said Sally Greenberg, executive director of the National Consumers League. Drivers who connect their smartphones and other devices via Bluetooth to their cars could be sharing their entertainment and eating habits as well as their entire contacts list with the car’s manufacturer, or with a rental car company, Greenberg said.

Two U.S. senators introduced a bipartisan bill that would ban “manipulative” design features and prompts that let large websites such as Alphabet’s Google or Facebook “trick consumers into handing over their personal data.”

Democratic Senator Mark Warner and Republican Senator Deb Fischer introduced the bill on so-called “dark patterns” on Tuesday, according to a news release from Warner’s office. Such features, based on behavioral psychology, include pre-checked boxes or pop-ups in the middle of an activity—such as an e-commerce purchase or reading a story online—that prompt users to consent to the collection of personal data.

The bill, which would only apply to websites with more than 100 million monthly active users, comes as anger with large internet platforms has led to rising calls for regulation. Although the bill introduced Tuesday is bipartisan, key committees that would have to legislate on the issue have not yet picked up the effort. So far, congressional efforts to pass a national privacy law have gained the most momentum with lawmakers.

“For years, social media platforms have been relying on all sorts of tricks and tools to convince users to hand over their personal data without really understanding what they are consenting to,” Warner, who serves as vice chairman of the Senate Intelligence Committee, said in a statement. The legislation is dubbed DETOUR, for “Deceptive Experiences to Online Users Reduction” Act.

For the first time, EU authorities have announced plans to recall a product from the European market because of a data privacy issue.

The product is Safe-KID-One, a children's smartwatch produced by German electronics vendor ENOX.

According to the company's website, the watch comes with a trove of features, such as a built-in GPS tracker, built-in microphone and speaker, a calling and SMS text function, and a companion Android mobile app that parents can use to keep track and contact their children.

Google has been fined nearly $57 million by French regulators for violating Europe's tough new data privacy rules, marking the first major penalty brought against a U.S. technology giant since the regionwide regulations took effect last year.

France's top data privacy agency, known as the CNIL, said Monday that Google failed to fully disclose to users how their personal information is collected and what happens to it. Google also did not properly obtain users' consent for the purpose of showing them personalized ads, the watchdog agency said.

To French regulators, Google's business practices ran afoul of Europe's new General Data Protection Regulation. Implemented in 2018, the sweeping privacy rules, commonly referred to as GDPR, have set a global standard that has forced Google and its tech peers in Silicon Valley to rethink their data collection practices or risk sky-high fines.

The United States lacks a similar overarching federal consumer privacy law, a deficiency in the eyes of privacy rights advocates that has elevated Europe as the world's de facto privacy cop.

A coalition of more than 75 consumer groups is urging the Federal Trade Commission (FTC) to investigate Google for allegedly manipulating Android users into having their location tracked at all times.

The Trans Atlantic Consumer Dialogue argued that Google “nudges” mobile phone users with Android operating systems to turn on their location services.

“Location data and history can reveal in detail an individual’s lifestyle, daily routines, and interests,” the groups wrote. “Over time, the data can be used to infer highly sensitive information such as religious beliefs, political views, and sexual orientation.”

US FTC stops internet marketers from giving deceptive free trial offers By Devdiscourse team A federal district court has granted the Federal Trade Commission’s request to stop a group of San Diego-based Internet marketers from deceptively advertising free trial offers and …

US FTC stops internet marketers from giving deceptive free trial offers

By Devdiscourse team

A federal district court has granted the Federal Trade Commission’s request to stop a group of San Diego-based Internet marketers from deceptively advertising free trial offers and not only charging consumers full-price for the trial product but also enrolling them in expensive, ongoing continuity plans without their knowledge or consent. The court order announced today temporarily halts the operation, freezes its assets, and appoints a temporary receiver over the business.

According to the FTC’s complaint, the defendants market and sell a variety of products online, including skin creams, electronic cigarettes, and dietary supplements. Advertising through third-party websites, blog posts, and surveys, the defendants allegedly offer consumers “RISK FREE” trials of products such as “Wrinkle Rewind,” “Erase Repair H/A,” “Pro Vapor,” “Cerebral X,” “Test X Core,” and “Garcinia Clean XT.”

In addition, the FTC alleges the defendants use deceptive order confirmation pages to trick consumers into ordering additional products, for which the defendants similarly charge consumers full price and enroll them in negative-option plans. The defendants then make it difficult to cancel the continuity plan, stop or avoid the recurring charges, or obtain a refund.

Gmail's new ‘confidential mode' offers more privacy controls — but don't get too comfortable

By Jaclyn Cosgrove

In rolling out major updates to Gmail, Google announced that the popular email service will soon feature a new “confidential mode” that promises to give users more control over who sees the emails they send, and for how long.

Users should still be mindful about what they send over email, privacy experts warned, as messages sent in confidential mode could still fall into the wrong hands.

With the new privacy feature, users will be able to remove recipients' options to forward, copy, download or print specific messages.

Confidential mode “is going to be presented by Google as all these wonderful features that customers are out there asking for, and that they're meeting customer demand, and while some of that may be true, it's necessary to remember it's also all about maximizing ways people will be enticed to continue to stay on Google's platform as much as possible so they can monetize your data, and when dealing with Google, one should never forget that,” Simpson said.

Live Nation, Ticketmaster’s parent company, announced that it will allow concertgoers to scan their faces for entry into shows, instead of showing up with a mobile or paper ticket. The pilot program will take place at select Live Nation venues, Ashley Dos Santos, Ticketmaster’s communications director, told The Daily Beast.

Ticketmaster partnered with Blink Identity, a biometrics company that claims its products can “identify people walking by in a ‘half a second,’ even if they aren’t looking straight at a camera,” The Verge reported. Blink’s founders have worked for government agencies and developed biometric security programs in Afghanistan and Iraq, according to the company’s website.
