<p>Energy bars from best-selling Bay Area brand Clif Bar are loaded with added sugars despite advertising to the contrary says a new lawsuit filed in the U.S. District Court for the Northern District of California last month.</p>
<p>“The claims, designed to appeal to health-conscious consumers, however, are deceptive because they are incompatible with the dangers of the excessive sugar consumption to which the products contribute,” the complaint states.</p>

<p>“This is about protecting the integrity of the products that farm and ranch families throughout the country work hard to raise each and every day,” said MCA Executive Vice President Mike Deering. “I never imagined we would be fighting over what is and isn't meat. It seems silly. However, this is very real, and I cannot stress enough the importance of this issue. We are beyond pleased to see this priority legislation cross the finish line.”</p>

<p>Having adopted amendments to the Food and Drugs Act that prohibit food and beverages marketed at children, MPs turned their attention on Monday to another beverage affecting Canada’s youth: Pre-mixed drinks combining alcohol, caffeine, and sugar.</p>

A national outcry about the accessibility of pre-mixed drinks erupted earlier this year, following the accidental death of 14-year-old Athena Gervais in Laval, Que. Police are still awaiting a toxicology report to determine whether a sugary alcoholic beverage sold in Quebec was a contributing factor.</p>
<p>Although these drinks are not directly targeted at minors, marketing, and online advertising are tailored to a young audience. While Éduc’alcool argues such beverages should be completely banned, the Canadian Centre on Substance Use and Addiction (CCSA), as well as Health Canada, believe the committee should be more strategic.</p>

<p>A consumer watchdog is weighing a probe into StarKist Tuna and its relationship with the American Heart Association, concerned that the pair have been misleading consumers for years.</p>

<p>The beef is that cans of StarKist tuna don’t disclose on their labels that the manufacturer has paid money to the AHA for the right to display the group’s “heart check” certification.</p>
<p>AHA certification does place limits on fat, salt and sugar for canned foods, among other criteria. But the AHA also quietly charges StarKist — and scores of other companies — an annual fee for the use of its mark, says TINA executive director Bonnie Patten.</p>

<p class="article-paragraph">The latest complaint comes from the Animal Legal Defense Fund (ALDF), which on March 15 filed a lawsuit, claiming that the Monrovia, Calif.-based grocer Trader Joe’s is trying to capitalize on consumers’ confusion over the real meaning of cage-free eggs.</p>
<p class="article-paragraph">The lawsuit was filed in the Superior Court of the State of California for the County of Alameda on behalf of Carolyn Claybaugh, a Danville, Calif. resident and Trader Joe’s shopper. The complaint states the company’s images of hens foraging outside, “in green, wide-open pastures,” is a “sham” and is meant to deceive shoppers into thinking the eggs come from chickens that are also pasture-raised, when in fact, those hens are still confined in indoor facilities and never go outside.</p>

<p class="article-paragraph">“There can be only one reason Trader Joe’s uses false representations of hens foraging outdoors on its Cage Free egg cartons: To trick consumers into believing that Trader Joe’s use of the term ‘cage-free’ is synonymous with hens humanely living outdoors,” ALDF states in the complaint.</p>
<p class="article-paragraph">“While the hens who lay Trader Joe’s Cage Free eggs are not confined to battery cages, they also never see the sunshine, grass, and natural living conditions depicted on Trader Joe’s Cage Free egg cartons. Instead … the hens who lay Trader Joe’s Cage Free eggs are never allowed to leave the indoor confines of industrial hen houses, and are never given access to grass, much less expansive pasture, upon which to roam, forage, and engage in other natural behaviors.”</p>
<p class="article-paragraph">The complaint alleges that the marketing tactic employed by Trader Joe’s violates a number of California consumer protection laws, including the Unfair Competition Law, False Advertising Law, and Consumer Legal Remedies Act.</p>

<p>Stone Brewing company is suing MillerCoors, claiming its recent Keystone rebrand is too close to their company name.</p>

“Stone, known for being the antithesis to ‘Big Beer,’ has long waved a flag of bold character, individualism and independence,” the press release annoucing the suit said. “The craft beer pioneer feels that it has no choice but to combat MillerCoors' aggressive marketing moves, which abandon Keystone's own heritage by falsely associating with the one true STONE®.”</p>
<p>“Keystone’s rebranding is no accident,” said Dominic Engels, Stone Brewing CEO. “MillerCoors tried to register our name years ago and was rejected. Now its marketing team is making 30-pack boxes stacked high with nothing but the word ‘STONE’ visible. Same for Keystone’s social media, which almost uniformly has dropped the ‘Key.’ We will not stand for this kind of overtly and aggressively deceptive advertising. Frankly, MillerCoors should be ashamed.”</p>

<p>The Federal Trade Commission has obtained an order against companies that allegedly ran ads on Facebook and Instagram to market a bogus get-rich-quick scheme.</p>
<p><a class="popup_DATA_BROKER" data-toggle="modal" data-target="#popup_DATA_BROKER_modal" href="#"><img decoding="async" src="/images/button_banner-Data_Broker.png" alt="" /></a></p>
<p>Digital Altitude, Aspire Processing and other related companies sold paid memberships to a program that was supposed to help consumers make extra money from home, the FTC alleged in a complaint unveiled Thursday. Some consumers paid more than $50,000 for their memberships, the FTC alleged in its complaint, filed in U.S. District Court for the Central District of California. In total, the companies allegedly raked in more than $14 million by duping consumers, according to the FTC.</p>
<p>On February 1, U.S. District Court Judge John Kronstadt in the Central District of California entered a temporary restraining order banning Digital Altitude and the other companies from misrepresenting their program. Kronstadt also froze the assets of the companies and their officers.</p>

<p>The Organic Consumers Association (OCA) recently filed a deceptive advertising lawsuit against tea-maker R. C. Bigelow, Inc., in the Superior Court of the District of Columbia. It claims that Bigelow should be held liable for “deceptive labeling, marketing, and sale of tea products” that they represent as “all natural” or environmentally friendly, because the teas actually contain glyphosate residue, the main herbicide in Roundup weed killer.</p>

<p>According to their complaint, tests of Bigelow Green Tea conducted by an independent laboratory revealed glyphosate at 0.38 parts per million (ppm).
