By Chavie Lieber

A lawsuit filed against Nestlé Waters, which owns Poland Spring, claimed that the company was deceiving customers by selling them “ordinary groundwater” that Poland Spring “collects from wells it drilled,” and marketing it as “100% natural spring water.”

The suit called Poland Spring’s water “a colossal fraud perpetrated against American consumers.”

Nestlé tried to get the case dismissed, a US district attorney in Connecticut ruled that plaintiffs from eight states, including Massachusetts, New York, and Pennsylvania, can pursue their lawsuit against the company.

This is not the first time Nestlé has been accused of false advertising. In 2003, according to the Washington Post, it paid $10 million to charity after it was hit with a similar class-action lawsuit regarding Poland Spring and false advertising.

The U.S. Federal Trade Commission, which investigates allegations of deceptive advertising, has sent warning letters to eight companies to insist they distinguish in advertisements between diamonds from mines and those made in laboratories.

The FTC said it had found instances where the eight companies advertised diamond jewelry “without clearly and conspicuously disclosing that the diamonds are laboratory-created,” according to the letter.

The agency declined to identify the recipients of the letters. An unredacted version of one of the letters seen by Reuters identified that recipient as Diamond Foundry, a California company that makes laboratory diamonds.

A popular family tracking app was leaking the real-time locations of more than 238,000 users for weeks after the developer left a server exposed without a password.

The app, Family Locator, built by Australia-based software house React Apps, allows families to track each other in real-time, such as spouses or parents wanting to know where their children are.

Based on a review of the database, each account record contained a user’s name, email address, profile photo, and their plaintext passwords.

Any user who had a geofence set up also had those coordinates stored in the database, along with what the user called them — such as “home” or “work.”

The FTC worked with AARP to create a series of videos about imposter scams – including Medicare scams, IRS imposters and robocalls. While the videos are aimed at older Asian Americans and Pacific Islanders, the tips apply to everyone. For the next three Fridays, we’ll highlight these videos.

The video will help you recognize the scammers who ask for your Medicare number so you can get a back or neck brace. Or who say they need your information or money so you can get a new Medicare card.

By Mike LaSusa

Epic Games Inc., the maker of the popular video game “Fortnite,” conned players into buying so-called loot boxes that rarely contained the valuable in-game accouterments promised by the company's advertising, according to a proposed class action filed in California federal court.

The suit filed claims Fortnite's “Save the World” game mode allows players to purchase loot boxes known as “Llamas,” which were marketed “as highly likely to contain valuable loot that will increase a player's power and prowess” but actually contained mostly basic items.

The complaint cites research indicating children may be less able to think critically about how in-game purchases are advertised, and alleges Epic exploits that naivete to reap huge profits.

By Michael Kan

Chrome extensions can certainly be useful, but many of them have no easily accessible privacy policies, according to new research. The security firm Duo published an analysis of 120,463 extensions and apps in the Chrome Web Store and found that 85 percent of them have no privacy policy listed on the platform.

At the same time, Google has also been taking steps to boost security around third-party extensions to prevent hacking risks.

Of course, many legit Chrome extensions need the ability to read your data from webpages to operate. In return, the extension can correct spelling mistakes as you type, translate the text that appears over a website, or help organize your emails.

The FTC is challenging fake Amazon reviews

By Daniel Keyes

The FTC targeted Cure Encapsulations, Inc. which sells a weight-loss supplement that is incorrectly associated with weight loss and poses medical risks, according to The Verge and its owner for their actions on Amazon's marketplace.

The company allegedly paid Amazonverifiedreviews.com to post fake reviews of its product to ensure it had a 4.3 out of a 5-star rating on Amazon. The paid 5-star reviews made “false and unsubstantiated claims” and were from fabricated consumers, drawing the ire of the FTC.

The FTC's complaint was filed on February 19 and a settlement has been reached that requires Cure Encapsulations to only make claims about products with suitable evidence.

Federal regulators fined social media app Musical.ly now known as TikTok $5.7 million for illegally collecting the names, email addresses, pictures and locations of kids under age 13, a record penalty for violations of the nation’s child privacy law.

The fine results from a settlement between the Federal Trade Commission and TikTok, which merged with California-based Musical.ly, over allegations of illegal data collection of children.

The FTC said TikTok had 65 million users registered in the United States, it was the fourth and 25th-most popular free app on Google and Apple devices.

Equifax expecting punishment from CFPB and FTC over massive data breach

By Ben Lane

Equifax is expecting various forms of punishment from the Consumer Financial Protection Bureau and the Federal Trade Commission over the credit reporting agency’s massive data breach that exposed the personal information of 148 million U.S. consumers to hackers.

The company did not provide an expected timeline for when the potential punishment will be announced, but the fact that the CFPB is seeking to find the company for the breach represents a shift from the bureau’s recent actions in the case.

The FTC launched its own investigation into Equifax after the breach was first exposed, and that action seems to be nearing its end as well, but those are hardly the only agencies and parties that are pursuing Equifax over the breach.
