<h1 class="post-title">In Groundbreaking Settlements, Attorneys General Find Fake Social Media Engagement Illegal</h1>

<p>The Office of the New York Attorney General (“NY AG”) and the Office of the Florida Attorney General (“Florida AG”) announced settlements with Devumi LLC and its offshoot companies (“Devumi”), which sold fake social media engagement, such as followers, likes and views, on various social media platforms. According to the NY AG, such social media engagement is fake in that “it purports to reflect the activity and authentic favor of actual people on the platform, when in fact the activity was not generated by actual people and/or does not reflect genuine interest.”</p>
<p><a class="popup_DATA_BROKER" data-toggle="modal" data-target="#popup_DATA_BROKER_modal" href="#"><img decoding="async" src="/images/button_banner-Data_Broker.png" alt="" /></a></p>
<p>These settlements are the first in the United States to find that selling fake social media engagement constitutes illegal deception and that using stolen social media identities to engage in online activity is illegal. The NY AG emphasized that the New York settlement sends a “clear message that anyone profiting off of deception and impersonation is breaking the law and will be held accountable.”</p>
<p>Devumi grossed $15 million dollars from 2015 to 2017 by selling fake social media engagement through bots and “sock puppet” accounts. A sock puppet account is the account of one person who is pretending to be many others. In other words, it is multiple accounts controlled by the same user. Some of the fake accounts used real social media profiles without the profile owner’s consent or knowledge.</p>
<p>The company also sold endorsements from social media “influencers” without disclosing that the endorsements were paid for. An influencer is a social media user with a substantial following, who monetizes their online popularity by endorsing goods, services and events to their followers.</p>

<p>Food delivery services can be a convenience for people with busy lives. Free trial offers and online reviews can help people decide which service they want to use.</p>

<p>But when reviews are deliberately skewed and subscription terms are hidden, that’s not just unhelpful. It’s against the law.</p>
<p>The FTC announced a settlement with UrthBox, Inc., a California-based food delivery service, and its owner, Behnam Behrouzi.</p>
<p>According to the FTC, UrthBox offered customers incentives, including free snack boxes, to post positive reviews online. But the company didn’t clearly tell people that customers who posted those reviews were rewarded.</p>

<p>Attorney General Mike Hunter announced that an $8.5 million settlement has been reached between the state, Volkswagen and related auto manufacturers in a case that accused the carmakers of false and deceptive advertising.</p>
<p>Oklahoma filed its lawsuit against the companies after a federal investigation found Volkswagen had deliberately installed software in diesel vehicles that aimed to cheat laboratory emissions tests.</p>
<p><a class="popup_SDLM" data-toggle="modal" data-target="#popup_SDLM_modal" href="#"><img decoding="async" src="/images/button_banner-SDLM.png" alt="" /></a></p>
<p>Investigators found the vehicles emitted as much as 40 times the amount of allowable nitrogen oxide under U.S. standards during real-world driving conditions.</p>
<p>“VW purposefully misled consumers in one of the most egregious cases of false advertising the automobile industry has ever seen,” Hunter stated in a release announcing the settlement.</p>

<p>This week, taking our battle against these puppy sellers one step further, we filed a legal petition with the Federal Trade Commission, the government agency tasked with preventing deceptive business practices, asking it to stop puppy sellers from using misleading advertising to attract unsuspecting buyers.</p>

<p>When it comes to eradicating a company's bogus pest-control claims, the Federal Trade Commission is finding one particular producer of &#8220;natural&#8221; pesticides to be a recurring nuisance.</p>
<p>Five years after agreeing to a consent order settling an FTC complaint about deceptively marketed bedbug and head-lice products, Chemical Free Solutions, or CFS, has reached another settlement.</p>
<p><a class="popup_SDLM" data-toggle="modal" data-target="#popup_SDLM_modal" href="#"><img decoding="async" src="/images/button_banner-SDLM.png" alt="" /></a></p>
<p>Beyond acknowledging it violated the 2013 order, the company is banned from selling eradication products, and it will have to make refunds to consumers, the FTC said in its latest settlement with CFS.</p>

<p>Energy bars from best-selling Bay Area brand Clif Bar are loaded with added sugars despite advertising to the contrary says a new lawsuit filed in the U.S. District Court for the Northern District of California last month.</p>
<p>“The claims, designed to appeal to health-conscious consumers, however, are deceptive because they are incompatible with the dangers of the excessive sugar consumption to which the products contribute,” the complaint states.</p>

<p>With Tesla’s Autopilot system under scrutiny following recent crashes, two consumer groups on Wednesday asked federal authorities to investigate the automaker for “dangerously misleading and deceptive advertising,” saying the company made its system seem closer to self-driving technology than it truly is.</p>

<p>Having adopted amendments to the Food and Drugs Act that prohibit food and beverages marketed at children, MPs turned their attention on Monday to another beverage affecting Canada’s youth: Pre-mixed drinks combining alcohol, caffeine, and sugar.</p>

A national outcry about the accessibility of pre-mixed drinks erupted earlier this year, following the accidental death of 14-year-old Athena Gervais in Laval, Que. Police are still awaiting a toxicology report to determine whether a sugary alcoholic beverage sold in Quebec was a contributing factor.</p>
<p>Although these drinks are not directly targeted at minors, marketing, and online advertising are tailored to a young audience. While Éduc’alcool argues such beverages should be completely banned, the Canadian Centre on Substance Use and Addiction (CCSA), as well as Health Canada, believe the committee should be more strategic.</p>
