<h1 class="post-title">In Groundbreaking Settlements, Attorneys General Find Fake Social Media Engagement Illegal</h1>

<p>The Office of the New York Attorney General (“NY AG”) and the Office of the Florida Attorney General (“Florida AG”) announced settlements with Devumi LLC and its offshoot companies (“Devumi”), which sold fake social media engagement, such as followers, likes and views, on various social media platforms. According to the NY AG, such social media engagement is fake in that “it purports to reflect the activity and authentic favor of actual people on the platform, when in fact the activity was not generated by actual people and/or does not reflect genuine interest.”</p>
<p><a class="popup_DATA_BROKER" data-toggle="modal" data-target="#popup_DATA_BROKER_modal" href="#"><img decoding="async" src="/images/button_banner-Data_Broker.png" alt="" /></a></p>
<p>These settlements are the first in the United States to find that selling fake social media engagement constitutes illegal deception and that using stolen social media identities to engage in online activity is illegal. The NY AG emphasized that the New York settlement sends a “clear message that anyone profiting off of deception and impersonation is breaking the law and will be held accountable.”</p>
<p>Devumi grossed $15 million dollars from 2015 to 2017 by selling fake social media engagement through bots and “sock puppet” accounts. A sock puppet account is the account of one person who is pretending to be many others. In other words, it is multiple accounts controlled by the same user. Some of the fake accounts used real social media profiles without the profile owner’s consent or knowledge.</p>
<p>The company also sold endorsements from social media “influencers” without disclosing that the endorsements were paid for. An influencer is a social media user with a substantial following, who monetizes their online popularity by endorsing goods, services and events to their followers.</p>

<p>The fear of being hacked was allegedly the hook used by Office Depot, its subsidiary OfficeMax, and a California tech-support vendor to dupe customers into paying for computer repairs and technical services they didn’t need, according to the Federal Trade Commission.</p>

<p>Although not admitting any wrongdoing, Office Depot and Support.com Inc. have agreed to pay $35 million to settle the claim they deceived customers into believing their computers were infected with malware and vulnerable to other security threats.</p>
<p>The FTC alleged that from at least 2009 to late 2016, the companies would offer customers a free “PC Health Check Program” to determine if their computers had any performance problems.</p>
<p>But the real purpose was to aggressively sell diagnostic and repair services to customers that, in many cases, they didn’t need, according to Claire Wack, the FTC’s lead attorney on the case.</p>

<p>Food delivery services can be a convenience for people with busy lives. Free trial offers and online reviews can help people decide which service they want to use.</p>

<p>But when reviews are deliberately skewed and subscription terms are hidden, that’s not just unhelpful. It’s against the law.</p>
<p>The FTC announced a settlement with UrthBox, Inc., a California-based food delivery service, and its owner, Behnam Behrouzi.</p>
<p>According to the FTC, UrthBox offered customers incentives, including free snack boxes, to post positive reviews online. But the company didn’t clearly tell people that customers who posted those reviews were rewarded.</p>

<p class="">The Food and Drug Administration and the Federal Trade Commission sent warning letters Tuesday to three companies that market CBD products, saying the companies are making false claims about treating diseases such as cancer and Alzheimer’s.</p>

<p class="">The agencies claim that three companies — Nutra Pure, PotNetwork Holdings, and Advanced Spine and Pain — are falsely advertising the effectiveness of supplements that contain cannabidiol, commonly known as CBD. The products are marketed under names such as “Hemp Oil,” “CBD Softgels,” “CBD for Dogs,” “Liquid Gold Gummies,” and “CBD Oil.” One company in particular — Nutra Pure — advertises that scientific research supports their claims that their CBD product is an effective anti-seizure medication.</p>

<p class="paragraph">A Maryland jury ruled unanimously in favor of a probiotic inventor who accused his former business partners and a Covington-based biomedical company of false advertisement among other charges.</p>

<p class="paragraph">Alfasigma was ordered to pay De Simone and his company ExeGi Pharma $15 million in damages. The inventor will receive close to $18 million in damages from the companies he argued attempted to create a copy of a probiotic he originally developed.</p>
<p class="paragraph">Commonly referred to as a medical food, probiotics are live microorganisms that can provide health benefits intended to restore the natural balance of gut bacteria. DeSimone’s formula is popular among patients with gastrointestinal conditions such as Irritable Bowel Syndrome and Crohn’s Disease, according to his attorney Jeremy W. Schulman who represented him and his company ExeGi during the trial.</p>

<p>FTC chairman Joseph Simons on Tuesday said he would investigate video game loot boxes to ensure that children are being protected and parents are educated on the matter.</p>
<p>The request comes about nine months after Hassan sent a letter to the Entertainment Software Ratings Board asking for the group to review the rating process as it relates to loot boxes, examine the marketing of loot boxes to children, and put together best practices for developers around the toxic form of microtransactions. The senator also asked the board to conduct a study that further delves into the reach and impact of loot boxes in games. At the time, she said if they didn’t take sufficient action she would ask the FTC to get involved.</p>

<p>“Loot boxes are now endemic in the video game industry and are present in everything from casual smartphone games to the newest, high-budget video game releases. Loot boxes will represent a $50 billion industry by the year 2022, according to the latest research estimates. Children may be particularly susceptible to engaging with these in-game purchases, which are often considered integral components of video games. Just this month Great Britain’s gambling commission released a report finding that 30% of children have used loot boxes in video games. The report further found that this exposure may correlate with a rise of young problem gamblers in the United Kingdom. Belgium, Netherlands, and Japan have moved to regulate the use of loot boxes in video games given this close link to gambling.</p>

<p>The owner of a supposed credit monitoring service will repay $5.2 million to deceived consumers for using fake rental properties to trick those consumers into signing up for the credit services.</p>
<p>According to the Federal Trade Commission, Michael Brown and his company, Credit Bureau Center, were found to have cheated consumers into signing up for ongoing credit monitoring services.</p>

<p>Brown and his company, which is formerly known as MyScore, and other co-conspirators placed ads on Craigslist for rental properties that either did not exist or that they had no right to rent.</p>
<p>According to the FTC, many of the victims did not realize they were enrolled in the credit services until they noticed unexpected charges on their bank or credit card statements.</p>
