Your car is watching you. Who owns the data?

By Gopal Ratnam

If you’re driving a late model car or truck, chances are that the vehicle is mostly computers on wheels, collecting and wirelessly transmitting vast quantities of data to the car manufacturer not just on vehicle performance but personal information, too, such as your weight, the restaurants you visit, your music tastes and places you go.

A car can generate about 25 gigabytes of data every hour and as much as 4,000 gigabytes a day, according to some estimates. The data trove in the hands of car makers could be worth as much as $750 billion by 2030, the consulting firm McKinsey has estimated. But consumer groups, aftermarket repair shops and privacy advocates say the data belongs to the car’s owners and the information should be subject to data privacy laws.

Yet Congress has yet to pass comprehensive federal data privacy legislation. And although Sen. Roger Wicker of Mississippi, chairman of the Senate Committee on Commerce, Science, and Transportation, has said he would like to see federal privacy legislation passed by the end of the year, it is unclear if that goal can be met.

Consumers are right to be concerned that, unknown to them, data collected by car companies could be shared with law enforcement agencies, just as online ancestry registries have shared DNA information with investigators, said Sally Greenberg, executive director of the National Consumers League. Drivers who connect their smartphones and other devices via Bluetooth to their cars could be sharing their entertainment and eating habits as well as their entire contacts list with the car’s manufacturer, or with a rental car company, Greenberg said.

Two U.S. senators introduced a bipartisan bill that would ban “manipulative” design features and prompts that let large websites such as Alphabet’s Google or Facebook “trick consumers into handing over their personal data.”

Democratic Senator Mark Warner and Republican Senator Deb Fischer introduced the bill on so-called “dark patterns” on Tuesday, according to a news release from Warner’s office. Such features, based on behavioral psychology, include pre-checked boxes or pop-ups in the middle of an activity—such as an e-commerce purchase or reading a story online—that prompt users to consent to the collection of personal data.

The bill, which would only apply to websites with more than 100 million monthly active users, comes as anger with large internet platforms has led to rising calls for regulation. Although the bill introduced Tuesday is bipartisan, key committees that would have to legislate on the issue have not yet picked up the effort. So far, congressional efforts to pass a national privacy law have gained the most momentum with lawmakers.

“For years, social media platforms have been relying on all sorts of tricks and tools to convince users to hand over their personal data without really understanding what they are consenting to,” Warner, who serves as vice chairman of the Senate Intelligence Committee, said in a statement. The legislation is dubbed DETOUR, for “Deceptive Experiences to Online Users Reduction” Act.

Chrome extensions can certainly be useful, but many of them have no easily accessible privacy policies, according to new research. The security firm Duo published an analysis of 120,463 extensions and apps in the Chrome Web Store and found that 85 percent of them have no privacy policy listed on the platform.

At the same time, Google has also been taking steps to boost security around third-party extensions to prevent hacking risks.

Of course, many legit Chrome extensions need the ability to read your data from webpages to operate. In return, the extension can correct spelling mistakes as you type, translate the text that appears over a website, or help organize your emails.

Federal regulators fined social media app Musical.ly now known as TikTok $5.7 million for illegally collecting the names, email addresses, pictures and locations of kids under age 13, a record penalty for violations of the nation’s child privacy law.

The fine results from a settlement between the Federal Trade Commission and TikTok, which merged with California-based Musical.ly, over allegations of illegal data collection of children.

The FTC said TikTok had 65 million users registered in the United States, it was the fourth and 25th-most popular free app on Google and Apple devices.

By Ben Lane

Equifax is expecting various forms of punishment from the Consumer Financial Protection Bureau and the Federal Trade Commission over the credit reporting agency’s massive data breach that exposed the personal information of 148 million U.S. consumers to hackers.

The company did not provide an expected timeline for when the potential punishment will be announced, but the fact that the CFPB is seeking to find the company for the breach represents a shift from the bureau’s recent actions in the case.

The FTC launched its own investigation into Equifax after the breach was first exposed, and that action seems to be nearing its end as well, but those are hardly the only agencies and parties that are pursuing Equifax over the breach.

According to the company's website, the watch comes with a trove of features, such as a built-in GPS tracker, built-in microphone and speaker, a calling and SMS text function, and a companion Android mobile app that parents can use to keep track and contact their children.

Influencers working with brands must follow FTC's Endorsement Guide and very clearly present paid posts as advertisements, but unfortunately, this basic standard is not being met all of the time.

Launching an e-commerce channel is an increasingly popular solution. On the plus side, it doesn’t have some of the sticky legal and trust issues associated with sponsored posts. But the downside is, it’s not quite as easy.

The company says this could lead to companies or users having their data stolen, published, or even shared with a government agency.

The Federal Trade Commission is in the advanced stages of its investigation into whether Facebook violated privacy rules and is expected to seek large fines from the company, according to two people familiar with the inquiry.

The five members of the commission met to discuss the investigation, according to the people, who would speak only on the condition of anonymity because the investigation is not public. The meeting is a sign that the investigation is far along, the people said, because the commissioners rarely meet in the early stages of an inquiry.

The investigation, which began in late March, is continuing, and the commissioners and staff have not reached a final conclusion, including how much the agency might seek in fines, the people said. Consumer-protection and enforcement staff members have provided updates on what they believe is evidence of privacy violations, but they have not submitted a final report.

The commissioners would vote on any recommendations from the staff, including whether to pursue fines or other penalties. They do not always approve staff recommendations.
